Welcome to Sue Sedberry dba The Growth Collective Life Coaching Group- GrowthCollectiveCoaching.com (“we,” “us,” or “our”). By using our website, services, forum, or any tools we provide, you agree to these Terms and Conditions. If you do not agree, please do not use our services.

1. Coaching Services

  • Our coaching services provide guidance and support but are not a substitute for professional medical, legal, financial, or psychological advice.
  • We do not guarantee specific outcomes. Your success depends on your efforts, background, and circumstances.
  • You acknowledge that you are responsible for your own decisions and actions. We are not liable for any results, losses, or damages arising from your use of our coaching services.

2. Forum and Community Guidelines

  • The forum is intended for life coaches to connect, share insights, and support one another.
  • You agree to post respectful and professional content. Harassment, hate speech, spam, or inappropriate behavior will result in account suspension or removal.
  • We are not responsible for any content posted by users and do not endorse any advice or opinions shared within the forum.

3. Tools, Plugins, and Resources

  • Any tools, plugins, or resources provided are offered “as is” without warranties of any kind.
  • We do not guarantee that tools or plugins will be error-free, uninterrupted, or compatible with all systems.
  • You assume full responsibility for using any tools, and we are not liable for any damages, loss of data, or website issues resulting from their use.

4. Limitation of Liability

  • We are not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our coaching, hosting, forum, or tools.
  • You use our services at your own risk.

5. Hosting Terms

  • Our Hosting Terms of Service apply to all users who purchase hosting services. These terms are outlined separately and can be found below these Terms and Conditions.

6. Changes to These Terms

  • We may update these Terms and Conditions at any time. Continued use of our services after changes are posted constitutes your acceptance of the updated terms.

Terms of Service Agreement for WordPress Web Hosting Services

Effective Date: March 1, 2025

This Hosting Agreement (“Agreement”) is entered into by and between Sue Sedberry dba Growth Collective Life  Coaching Group (“Growth Collective Coaching”, “We”, “Our”, “Us”) and the individual or entity using the hosting services (“Client”, “You”, “Your”). By purchasing hosting services through the Growth Collective Coaching website, you acknowledge that the services may be provided by a company or contractor that we feel will best fulfill these services on our behalf.

  1. Service Levels, Features, and Pricing

The following hosting plans are available for purchase through the Growth Collective Coaching website. Growth. We may, at our sole option, choose to contract our hosting services with another company or provider to ensure the best performance for our coaches.

Vision Launch Package – $5 per month

  • Storage: Up to 1 GB
  • Bandwidth: Up to 1,000 visitors/month
  • Websites/Domain: 1 WordPress website and 1 existing domain
  • Email Accounts: No email accounts included; email services can be purchased from third-party providers.
  • SSL Certificate: Included
  • Backups: Not included; the Client is responsible for backing up website data
  • Support: Email support within 48 hours during regular business hours

 

Ascend Hosting Package – $15 per month

  • Storage: Up to 2 GB
  • Bandwidth: Up to 5,000 visitors/month
  • Websites/Domain: 1 WordPress website and 1 existing domain
  • Email Accounts: No email accounts included; email services can be purchased from third-party providers
  • SSL Certificate: Included
  • Backups: Daily backups included
  • SEO Tools: Basic SEO optimization included (Yoast SEO, Google Search Console, Smush Image Compression, Schema & Structured Data for WP)
  • Support: Priority email support, answered within 24 hours during regular business hours
  • WP Website Migration: Free WP migration.

 

Success Suite Package – $24 per month

  • Includes all features from the Ascend Hosting Package
  • CDN: Content Delivery Network included
  • Blog Articles: Two 300-word blog articles per month in the requested niche
  • Backlinks: 5 DA 10+ backlinks per month
  • E-commerce Setup & Optimization: WooCommerce or similar
  • Support: Priority phone support during regular business hours.

 

Infinite Success Package – $29 per month

  • Includes all features from the Success Suite Package
  • WordPress Customization: 30 minutes of WordPress customization per month
  • SEO Optimization: 10 website pages optimized per month
  • Professional Email Account: One professional email account is included (if the domain is purchased and/or hosted by us.
  • Chat Plugin: Installation and setup included
  • Support: Priority email support, answered within 4 hours during regular business hours.

 

2.0 Payment Terms

2.1 Payment Method

  • All payments are due monthly. A 12-month minimum commitment is required for all hosting plans.
  • Payments must be made through Square unless an alternative payment method is specified by Growth Collective Coaching.
  • Late Payments: If a payment is not made on the due date, a second payment attempt will be made within 24 hours. If payment still fails, the website will be suspended. After 15 days of non-payment, the website will be removed from the server.
  • Reinstatement Fees: $50 for reinstating a suspended website; $100 for reinstating a website that has been removed. Reinstatement is at the sole discretion of New Heights Digital Solutions.

 

2.2 Refund Policy

There are no refunds for services provided under any plan. Clients are required to fulfill the 12-month commitment regardless of service usage.

 

3.0 Service-Level Agreement (SLA)

3.1 Uptime Guarantee
New Heights Digital Solutions guarantees 99.9% uptime for hosted services, excluding scheduled maintenance periods.

3.2 Response Time for Support

  • Response time for support requests will vary depending on the plan, as outlined below:
    • Vision Launch Package: Email support within 48 hours during regular business hours.
    • Ascend Hosting Package: Priority email support, answered within 12 hours during regular business hours.
    • Success Suite Package: Priority email and phone support, answered within 8 hours during regular business hours.
    • Infinite Success Package: Priority email and phone support, answered within 4 hours during regular business hours.

 3.3 Scheduled Maintenance
Scheduled maintenance will be minimal and typically occur after standard business hours. Clients will be notified at least 24 hours in advance of any planned maintenance.

 

4.0Account and User Responsibilities

4.1 User Obligations
The Client is responsible for:

  • Ensuring proper use of the hosting service, which includes not engaging in illegal activities such as spamming, distributing malware, or violating copyright or intellectual property laws.
  • Backing up their website and content if it is not included in their chosen hosting package. New Heights Digital Solutions is not responsible for backing up Client data unless specifically included in the service level.
  • Keeping login credentials secure.

 

4.2 Restrictions on Content
The following types of content are strictly prohibited:

  • Illegal content: Hosting child pornography, gambling, pirated software, or any illegal activity.
  • Hate speech or violence: Content promoting hate, violence, or discrimination.
  • Spam or phishing: Websites that engage in spamming or phishing activities.
  • Malware: Hosting malicious software or distributing malware.

 

5.0 Term and Termination

5.1 Initial Term
The initial term of service is 12 months. This term will automatically renew for subsequent 12-month periods unless the Client provides written notice of termination at least 30 days before the end of the current term.

5.2 Termination Conditions

Non-payment or breach of the terms is grounds for immediate termination of services. Upon termination due to non-payment or breach, the Client has no recourse to retrieve their data or website.

Data Transfer: Upon termination, the Client is responsible for transferring their domain and migrating their website data. Failure to do so before the termination date will result in permanent loss of data.

6.0 Support and Maintenance

6.1 Support
Client support is available during regular business hours (Monday through Friday, 8 AM – 5 PM PST, excluding holidays) through:

Email support (Vision Launch, Ascend, Success Suite, and Infinite Success Packages)

Phone support (Success Suite and Infinite Success Packages)

6.2 Maintenance
Scheduled maintenance will be minimal and communicated to Clients at least 24 hours in advance. Maintenance will typically take place outside of standard business hours to minimize disruption.

7.0 Data Privacy and Security

7.1 Data Protection
Client data is encrypted and protected according to the best industry practices. However, clients are responsible for ensuring that any third-party plugins or services they use are compliant with applicable data protection laws, such as GDPR or CCPA.

7.2 Backup and Data Recovery

If a site needs to be restored from a backup, a $50 fee will apply, payable before restoration begins. Restoration may take up to 3 business days.

8.0 Liability and Indemnification

8.1 Limitations on Liability
New Heights Digital Solutions is not liable for any loss of data, service interruptions, or any damages arising from the use of the hosting services.

8.2 Indemnification
The Client agrees to indemnify and hold harmless Growth Collective Coaching, and any of their partners, contractors, or service providers, including their owners, from any legal claims, losses, or damages arising from the Client’s use of the hosting services.

9.0 Dispute Resolution

9.1 Dispute Resolution Process
Any disputes arising under this Agreement will be resolved through binding arbitration, which shall be paid for by the party bringing the dispute.

9.2 Governing Law
This Agreement shall be governed by the laws of the State of Texas.

10.0 Changes to Terms

10.1 Modifications
Growth Collective Coaching reserves the right to modify or update the terms of this Agreement at any time.

10.2 Notification of Changes
Clients will be notified of major changes to these terms via email.

10.3 User Recourse
If a Client does not agree to any modifications, they may choose not to renew their services at the end of the current term.

11.0 Additional Legal Considerations

11.1 Intellectual Property Rights
All intellectual property related to the hosting services, including trademarks and logos, remain the property of Growth Collective Coaching and their service providers, if any.

11.2 Local Laws
This Agreement is governed by the laws of the State of Texas, and the parties agree to comply with all applicable federal, state, and local laws.
